Compliance with tax regulations and VAT
Notice regarding the language priority of the web terms.
In the event of any inconsistencies, contradictions or errors in translation between the English and Czech versions of our web terms, the Czech version shall be the primary and final terms. Czech conditions take precedence and will always apply over English conditions. 1. General:
a) We recommend that all creators seek professional advice to ensure you comply with local tax and VAT rules based on your individual circumstances.
b) By using GayPlanet as a creator, you warrant (meaning you make a legally enforceable promise) that you have reported and will in the future report the receipt of all payments made to you in connection with your use of GayPlanet to the appropriate tax authority as this is required by law.
c) By using GayPlanet as a creator, you warrant (meaning you make a legally enforceable promise) that you will always comply with all tax laws and regulations that apply to you. If, at any time while you have a GayPlanet account, you incur any tax non-compliance (including failing to report income or incurring any tax-related penalty or interest) or litigation, an inquiry or investigation is initiated against you, which is related to or may lead to any tax non-compliance, you agree that:
I. You notify us by e-mail at [email protected] within 7 days of the occurrence of a tax discrepancy or the initiation of a lawsuit, inquiry or investigation (depending on the situation); and
II. you will immediately provide us with information to the address [email protected] s: III. details of the steps you are taking to address the occurrence of tax non-compliance and to prevent a recurrence, together with any mitigating factors you consider relevant; and IV. other information in connection with the occurrence of tax non-compliance that we may reasonably request.d) For the avoidance of doubt, you are responsible for your own tax affairs and we are not responsible for advising you on your tax matters and we are not responsible for any general information provided on GayPlanet in relation to tax and we will not be liable for any non-payment of tax by the creators.
e) We reserve the right to close your GayPlanet account if we are notified or become aware of any tax non-compliance by you.
f) You agree to keep copies of all VAT invoices and VAT returns relating to your income from GayPlanet and to provide us with copies of such documents within 14 days of our written request. For the avoidance of doubt, it is your duty to comply with all provisions of VAT legislation and to obtain, give, obtain, maintain and retain accurate, complete and up-to-date records, invoices, accounts and other documents required for the purposes of VAT law.
g) If you are a creator who is not required to register for VAT, you should monitor the level of taxable sales you make (including any referral payments) to ensure that you have not exceeded the threshold for VAT registration. It is therefore your duty as a taxable person to monitor whether you have exceeded the threshold for VAT registration.
h) We do not track earnings that Creators receive from other sources of income. However, we will track the annual earnings of creators on our platform, and if you are not already a VAT payer and your earnings exceed the threshold for VAT registration, you will receive a notification from us asking you to register for VAT. If you receive such a VAT registration notice, you agree to register for VAT as soon as possible and send us your VAT registration number to [email protected] within 6 weeks of such notice. Failure to do so may result in your GayPlanet account being closed. At the same time, if you are a natural person who is not an entrepreneur, we will monitor the annual earnings and the regularity of the earnings, so that this is a legal casual activity.
i) GayPlanet is not a VAT payer.
